Failure to prioritize is not simply a “fine.” In 2026, for not giving priority to pedestrians when crossing or for not giving way to vehicles that have the right of way, Romanian legislation provides for a fine (class III) and suspension of driving rights for a period of up to 60 days.

What does «non-priority» mean in legal terms?

In road traffic, the «right of way» is the right of a road user to pass before another, according to the rules and signs. If you do not respect the “Give way” sign, “STOP”, the traffic light, the rules of intersections (including roundabouts) or pedestrian crossings, you can commit the act of “not giving priority”.
(The rules relating to approaching the intersection and the obligation to give way are set out in the Romanian Highway Code – including the obligation to approach at a speed that allows the vehicle to stop to give way.)

The most frequent situations for which motorists receive a fine in Romania

Failure to give priority to the pedestrian

  • the pedestrian enters the crossing or is already on the crossing, crossing regularly,
  • is in your lane/direction of travel,
  • the driver doesn’t slow down or stop, even though he should.

Failure to give priority to a vehicle

  • exiting a road without priority / under the «Give way» sign,
  • incorrect assessment of priority at an intersection without traffic lights,
  • merge into traffic without making sure to force the right of way.

What is the penalty for not granting priority in 2026, in Romania?

For failure to give way to pedestrians at the intersection and for failure to give way to vehicles having this right, a grade III fine is applied and the suspension/maintenance of the license for up to 60 days.

Legal basis:

  • Art. 101 out. (3) lit. A) – do not give way to pedestrians who are crossing legally on the pedestrian crossing in your direction
  • Art. 101 line. (3) lit. F) – do not give way to vehicles that have the right of way
  • The introduction of paragraph 3 expressly indicates: branch III + suspension of up to 60 days

How is the fine calculated?

In 2026, 1 penalty point represents 5% of the gross minimum wage set by the government. In February 2026, the minimum gross wage is 4,050 lei, so 1 fine point = 202.5 lei.

Legal formula: 1 point fine = 5% of the gross minimum wage.

«Class III» – how many penalty points?

Class III means 6-8 penalty points.

Failure to give priority to pedestrians at the intersection: when do you receive a fine?

If you do not give way to pedestrians crossing legally on the crossing, in your direction of travel, you will be issued a fine.

The most common situations:

  • the pedestrian stepped onto the pedestrian crossing and you «slipped» in front of him,
  • turn right/left and cross the intersection, even if the pedestrian is crossing legally,
  • reduced visibility, but you do not slow down and are not willing to stop at the intersection.

Failure to prioritize vehicles: where does this happen most often?

You receive a penalty when you do not give priority to vehicles that have the right to do so (according to signs/traffic lights/regulations).

The most common contexts:

  • intersections with «Give way» / «STOP»,
  • intersections without signals (right priority rule),
  • roundabout (priority to those already in the roundabout, if indicated by signs).

Suspension of license for failure to grant priority

For not having granted the right of way (pedestrians/vehicles) pursuant to art. 101 par. (3), the license suspension applies for a maximum period of 60 days.

In practice, during control:

  • the police officer draws up the report of the violation,
  • can order the withdrawal of the authorization (technical-administrative measure) and issue proof/replacement, depending on the situation.

Payment of fine in Romania

You have two basic options: you can pay less within 15 days and/or you can appeal within 15 days of notification of the fine.

  1. Payment in 15 days
    You can pay 50% of the prescribed minimum fine in 15 days.
  2. Appeal (complaint of contravention)
    The complaint must be presented to the competent court within 15 days of communication of the report.

How much is the fine for not granting priority in Romania in 2026?

Failure to prioritize is a class III misdemeanor, or 6-8 fine points. In the first half of 2026 this means 1,215 – 1,620 lei. From July 2026, the amount increases to 1,297.5 – 1,730 lei due to the increase in the minimum wage.

Can I lose my license for not giving priority?

YES. In addition to the financial penalty, the license is suspended for up to 60 days, both for failure to give way to pedestrians and vehicles that have the right of way.

How is the fine calculated in Romania?

Can I pay less if I pay quickly?

YES. You have 15 days from notification of the report to lodge a complaint with the competent court. Important: you can pay the fine with a 50% discount and also appeal.

What provisions regulate the sanction for failure to grant priority in Romania?

The sanctions derive from the art. 101 par. (3) of the Highway Code – letter e) to not give priority to pedestrians, letter f) to not give priority to vehicles. In both cases: third degree fine and suspension of the driving license for up to 60 days.
